Terms & Conditions

1. You have to register or log in to make a purchase.
2. Prices indicated online may differ from prices indicated at other stores, because of Web specials or in-store specials.
3. Please take note that you may add Web special items to your Wishlist, but when you purchase these items you will be billed according to the items' price on the date of purchase, if the items are no longer marked as a Web special.
4. All prices quoted are inclusive of VAT and excludes the shipping cost.
5. Shipping charges can be updated at any time with or without prior notice.
6. Credit card details must be provided when making a purchase, as credit card details cannot be stored on the system.
7. Door-to-door delivery is available in order to receive your parcel speedily. To ensure that delivery is not delayed, please provide an address where there will be someone available to sign for the parcel.
8. Delivery in South Africa will take place within 7-14 days after placing an order. If there are any delays, you will be notified as soon as possible.
9. Back-order items will be ordered per the customer's request. No payment will be requested at this point. Communication will follow as soon as the back-order item is in stock. The customer can then purchase this item by following the normal purchase procedure.
10. You may return any faulty or damaged items within 30 days of delivery for a replacement, provided that we are notified within 48 hours of you receiving the goods.
11. Refunds will only be given if you received the incorrect product or an order could not be fulfilled. Please take note that we do not provide refunds for the following items: CDs, DVDs, Software, and E-books.
12. By subscribing to the CUM Books Newsletter, you give CUM Books permission to send you their newsletter, which includes special offers, to the e-mail address that you had registered with.
13. CUM Books is backed by MyGate with 3D Secure, which guarantees complete security when using your credit card for payment.
14. All customer information received will be subject to CUM Books' Privacy Policy, in accordance with its terms as amended from time to time.
15. There is a limited stock of all goods on offer. CUM Books will make all reasonable efforts to notify the customer when a product is no longer available, and will only be liable to provide refunds where it is unable to fulfill orders at advertised prices.
16. CUM Books vouchers cannot be exchanged for cash and are not transferable or assignable.
17. The information contained on this website is subject to errors and omissions. Information is provided by third parties and CUM Books accepts no responsibility for inaccuracies.
18. Without prior notice to their customers and with or without providing any reasons, CUM Books may at any time, in its sole discretion, suspend or terminate the operation of the site or any of the services advertised or provided on the site.
19. Neither CUM Books, its holding company, associates, consultants, or employees will be liable for any damages relating to the use of this site, irrespective of the cause of your loss. Without affecting the foregoing, we are not liable for:
    a)    Any interruption; malfunction; downtime, or other failure of the site or computer systems for whatever reason;
    b)    Any interruption, malfunction, downtime, or other failure of goods or services provided by third parties, including without limitation: public switched telecommunication service providers, Internet service providers, electricity suppliers, local authorities, and certification authorities; or
    c)    An event of force majeure or any other event over which CUM Books has no direct control.
20. CUM Books reserves the right to amend these terms and conditions at any time. All amendments to these terms and conditions will be posted on the site. Whenever you access the site you will be bound to the current version. Continued use of this site will constitute acceptance of the current version. Unless otherwise stated, the current version shall supersede and replace all the previous versions of these terms and conditions.

eBooks

"eBooks" and "Links" thereto eBooks

In these T&C, an "eBook" means an electronic book, in .pdf or .epub format, capable of being opened and read on your PC, Mac or certain other hardware devices or Adobe Digital Editions software ("Adobe Reader"), such digital content reader applications hereinafter referred to as "Reader Applications". Your access to any eBook purchased by you from CUM Books will be granted via a link to such eBook's .acsm file ("Link")

Limits to functionality and usage of eBooks:

eBooks will not be readable on devices that do not support either of the Reader Applications.

Please note that CUM Books’ eBooks can only be read on the following devices: iPad, iPod & an iPhone Touch.

Even if a device supports either of the Reader Applications, eBooks can only be read on such Device/s if you have associated it with your profile in the Reader Application. If you have not registered with one of the Reader Applications, you will only be able to read the eBook on the device onto which it was first downloaded.

You  need to be connected to the Internet when you download an eBook and to open it for the first time. On subsequent openings of the eBook you will not need to be connected to the Internet, provided you are opening the eBook from the device you registered with the relevant Reader Application when you first downloaded and opened the eBook.

Illegal Use of eBooks

All eBooks are the exclusive property of CUM Books or its licensors and is protected by copyright and other intellectual property laws. The download of eBooks is intended for your personal and non-commercial use. Any other use of eBooks purchased from CUM Books is strictly prohibited.

You may not modify, transmit, publish, participate in the transfer or sale of, reproduce, create derivative works from, distribute, perform, display, or in any way exploit, any of the content of eBooks, in whole or in part, and more specifically, you will not print, copy, or 'lend' eBooks to any other person ("Illegal Activities"). By downloading any eBook, you hereby acknowledge and agree to these terms. You hereby undertake that you shall not attemp to do any of the Illegal Activities and should any of the Illegal Activities be possible for some reason, you undertake to not do so. You hereby indemnify CUM Books from any and all loss, damage, or expense it may suffer or from claims which may be made by third parties against CUM Books which arise from or in relation to your having participated in any Illegal Activities in relation to any eBook sold by CUM Books.

Please note that all eBook purchases are non refundable.

Ordering eBooks from CUM Books

When purchasing an eBook from CUM Books, you will be purchasing the right to download such eBook from the relevant publisher's website and consequently, delivery will take place electronically via the internet as described below.

Practical issues to note in utilising the Link to download the eBook:

The Link will contain your unique reference number as allocated by the publisher of the eBook

By clicking on the Link, a small locator file, unique to you, will be downloaded explaining where you can go to download the eBook.

Please take note: The .epub/.pdf files are digital right management (DRM) encrypted and are served via the Adobe Content Server (ACS). Please make sure that the DRM files via ACS are readable on your reader, it can only be read on certain devices. CUM Books cannot be held responsible if you cannot read the file on your reader.
